Comply with applicable laws and legal obligations3. AdvertisingFairway 6 uses Google AdMob to provide advertisements, including rewarded advertisements. Fairway 6 is configured to request non-personalized advertisements.Non-personalized does not necessarily mean that no information is collected. Google and its advertising partners may process information such as device identifiers, IP addresses, advertisement interactions, and technical information to deliver ads, prevent fraud, measure performance, and comply with legal obligations.We do not intentionally use information collected through Fairway 6 to create personalized advertising profiles. Google explains that non-personalized ads do not use demographic targeting or user-list targeting for personalization. (Google AdMob information)4. Third-Party ServicesFairway 6 currently uses or integrates with third-party services that may process information under their own privacy policies, including:Apple and Sign in with Apple

Satisfy legal, accounting, and security obligationsSome information may remain in backups for a limited period after deletion. We may retain information when legally required or when reasonably necessary to prevent fraud or protect the Services.Aggregated or de-identified information that can no longer reasonably identify you may be retained for analytics, development, and operational purposes.7. Account and Data DeletionYou may initiate permanent account deletion from within the Fairway 6 application through its account or settings controls.You may also contact [email protected] for assistance with an account or privacy request. We may need to verify that you control the account before fulfilling the request.Deleting Fairway 6 does not automatically delete information held separately by Apple, Google, Game Center, or other third-party providers. Saved statistics and match history
Progress and achievements
Golf Chip balance
Earned or unlocked decks
Other account-linked virtual contentInformation that we are legally required or reasonably permitted to retain may not be deleted immediately.8. Children’s PrivacyFairway 6 is intended for users who are at least 13 years old. We do not knowingly collect personal information from children under 13.If we learn that information was collected from a child under 13, we will take reasonable steps to delete it. A parent or guardian who believes that a child under 13 has provided personal information may contact us at [email protected].Users between 13 and the age of legal majority where they live should use the Services only with permission from a parent or legal guardian.9. SecurityWe use reasonable administrative, technical, and organizational measures intended to protect information. However, no application, network, database, or transmission method can be guaranteed to be completely secure.You are responsible for protecting access to your Apple or Google account and for notifying us if you believe your Fairway 6 account has been compromised.10. AccountsCertain features require an account created through Sign in with Apple or Sign in with Google.You agree to:Provide accurate information
Maintain control and security of your sign-in account
Not share, sell, or transfer your Fairway 6 account
Notify us if you suspect unauthorized access
Accept responsibility for activity conducted through your accountWe are not responsible for loss caused by unauthorized access resulting from your failure to protect your Apple or Google account.3. License to Use Fairway 6Subject to these Terms, Fairway 6 grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Services for personal, noncommercial entertainment.You may not:Copy, modify, distribute, sell, lease, or sublicense the Services
Reverse engineer or attempt to extract source code except where legally permitted
Circumvent security, access controls, or technical restrictions
Use bots, scripts, automation, exploits, or unauthorized software
Interfere with servers, matchmaking, advertisements, or other users
Use Fairway 6 for unlawful or commercial purposes without permissionYour use of the iOS application is also subject to Apple’s applicable App Store terms and standard end-user license agreement.4. Acceptable ConductYou agree not to:Cheat, exploit bugs, manipulate results, or falsify achievements
Intentionally disconnect or abuse matchmaking systems
Harass, threaten, impersonate, or abuse another person
Use an offensive, deceptive, infringing, or inappropriate username
Attempt to access another user’s account
Disrupt the Services or overload their infrastructure
Fraudulently obtain Golf Chips, decks, rewards, or purchases
Manipulate advertisements or rewarded-advertisement systems
Violate applicable laws or the rights of othersWe may remove usernames, invalidate results, remove improperly obtained items, restrict features, suspend accounts, or permanently terminate access when we reasonably believe these Terms have been violated.5. Online MatchesOnline matchmaking depends on internet access, server availability, and the participation of other users. We do not guarantee that:An opponent will always be available
A match will be uninterrupted
Matchmaking will produce opponents of equal skill
Every game result will be recoverable
Statistics will always be error-freeFairway 6 may apply temporary matchmaking restrictions or other penalties when a player leaves an online match early, disconnects intentionally, cheats, or violates game rules.Technical interruptions, maintenance, connection failures, or unexpected errors may affect results, statistics, rewards, or access.6. Golf Chips and Virtual ContentFairway 6 may provide Golf Chips, decks, cosmetic items, achievements, rewards, or other virtual content. These items may be earned through gameplay, obtained by watching advertisements, or purchased using real money.Unless otherwise required by law:Virtual items have no cash value
Virtual items are not legal currency or property
Virtual items cannot be redeemed for cash
Virtual items cannot be sold or transferred
You receive only a limited license to use them within Fairway 6
We may adjust, replace, limit, or discontinue virtual items for balancing, security, technical, or operational reasonsDeleting an account may permanently remove virtual items and balances associated with that account.7. Purchases and RefundsPurchases made through the iOS application are processed by Apple and are subject to Apple’s payment terms and refund policies.Prices and available products may change. Applicable taxes may be added by the platform processing the transaction.Except where required by law or permitted by Apple, purchases are final and nonrefundable. Refund requests for App Store purchases should be directed to Apple.If a purchase is reversed, refunded, fraudulent, or otherwise invalidated, we may remove the corresponding Golf Chips, decks, entitlements, or virtual content.8. AdvertisementsFairway 6 may display advertisements provided by Google AdMob or other advertising partners.Some advertisements may offer optional rewards. A reward may require the advertisement to be watched or completed successfully. We do not guarantee that an advertisement will always be available or that every attempted advertisement will qualify for a reward.Third-party advertisements and their destinations are controlled by their respective providers. Fairway 6 does not endorse and is not responsible for third-party products, services, claims, websites, or content displayed through advertisements.9. Apple Game Center and Other ServicesFeatures using Apple Game Center, Sign in with Apple, Google Sign-In, Google AdMob, or other third-party services are also governed by the terms and policies of those providers.We are not responsible for the availability, security, accuracy, or operation of a third-party service.10. Intellectual PropertyFairway 6 and its original software, artwork, card designs, interfaces, text, graphics, branding, sounds, features, and other content are owned by Fairway 6 or used with permission and are protected by applicable intellectual-property laws.“Fairway 6 – Card Golf,” associated branding, and related assets may not be copied or used without prior written permission.You retain ownership of content you submit to us. By submitting feedback, suggestions, or ideas, you grant Fairway 6 a worldwide, perpetual, irrevocable, royalty-free license to use and incorporate that feedback without compensation or obligation.11. Updates and ChangesWe may update, modify, rebalance, suspend, or discontinue any part of the Services at any time. This may include changes to:Game rules and scoring
Matchmaking
Rewards and achievements
Golf Chip earning rates
Decks and virtual content
Advertisements
Prices
Compatibility and technical requirementsWe do not guarantee that any particular feature or item will remain available permanently.12. Suspension and TerminationYou may stop using the Services at any time and may initiate deletion of your account through the app.We may restrict, suspend, or terminate access if:You violate these Terms
We reasonably suspect fraud, cheating, or abuse
Your activity threatens users or the Services
We are required to do so by law
Continuing to provide the account creates technical, security, or legal riskTermination may result in loss of progress, statistics, Golf Chips, decks, rewards, and other virtual content.13. Disclaimer of WarrantiesTo the fullest extent permitted by law, the Services are provided “as is” and “as available.”Fairway 6 disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, noninfringement, uninterrupted operation, accuracy, and security.We do not guarantee that the Services will always be available, error-free, secure, compatible with every device, or free from data loss.Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.14. Assumption of RiskYou use the Services at your own risk. You are responsible for your device, internet connection, account security, and decisions made while using the Services.This provision does not waive responsibilities that Fairway 6 cannot lawfully disclaim, including applicable privacy, consumer-protection, or product obligations.15. Limitation of LiabilityTo the fullest extent permitted by law, Fairway 6 and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of data, progress, virtual content, profits, or access arising from use of or inability to use the Services.To the fullest extent permitted by law, Fairway 6’s total liability for claims connected to the Services will not exceed the greater of:The amount you paid directly for Fairway 6 during the 12 months before the claim; or
Fifty U.S. dollars ($50)These limitations do not apply where prohibited by law.16. IndemnificationTo the extent permitted by law, you agree to defend, indemnify, and hold harmless Fairway 6 from claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person’s rights.This section does not apply where prohibited by applicable consumer law.17. Governing LawThese Terms are governed by the laws of the State of Colorado and applicable federal laws of the United States, without regard to conflict-of-law principles.Any legal action concerning these Terms or the Services must be brought in a court with proper jurisdiction in Colorado, unless applicable consumer law gives you the right to bring a claim elsewhere.Fairway 6 may be made available throughout the United States, but “USA-wide” cannot itself function as the governing law because laws vary by state. Colorado is the most logical choice because that is where the game is operated.18. Changes to These TermsWe may update these Terms when the Services, business practices, or legal requirements change.Updated Terms will be posted with a revised “Last Updated” date. Your continued use after an update becomes effective constitutes acceptance where permitted by law. If you do not agree to revised Terms, you must stop using the Services.19. SeverabilityIf any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. An unenforceable provision will be modified only to the minimum extent necessary to make it enforceable.20. Entire AgreementThese Terms, the Privacy Policy, Apple’s applicable App Store terms, and any additional rules displayed within Fairway 6 form the agreement governing your use of the Services.21. END USER LICENSE AGREEMENTEffective Date: August 23, 2026This End User License Agreement (“Agreement”) governs your use of the Fairway 6 – Card Golf mobile application, associated features, virtual currency, online services, and related content (collectively, the “Application”).This Agreement is between you and Robert Duval (“Developer,” “we,” “us,” or “our”). By downloading, accessing, or using the Application, you agree to these terms.If you do not agree, do not download or use the Application.AGREEMENT BETWEEN USER AND DEVELOPERThis Agreement is between you and the Developer only. Apple Inc. (“Apple”) is not a party to this Agreement.The Developer, not Apple, is responsible for the Application, its content, and its operation.Your use of the Application must comply with applicable Apple Media Services Terms and Conditions and other Apple usage requirements.LICENSE TO USE THE APPLICATIONThe Developer grants you a limited, personal, nonexclusive, nontransferable license to use the Application on Apple-branded devices that you own or control, subject to this Agreement and Apple’s applicable usage rules.Where permitted by Apple, the Application may be accessed through applicable Family Sharing, volume purchasing, or Legacy Contacts arrangements.You may not sell, sublicense, distribute, copy, reverse engineer, modify, decompile, or attempt to extract the Application’s source code, except where applicable law expressly permits such activity.All rights not expressly granted remain with the Developer or the applicable rights holder.AGE REQUIREMENTSThe Application is intended for users who are at least 13 years old.If you are under 18 years old or the age of legal adulthood in your jurisdiction, you must have permission from a parent or legal guardian to use the Application.By accessing the Application, you represent that you meet these requirements.ACCOUNT REGISTRATION AND SECURITYCertain Application features require an account, including accounts created through Sign in with Apple, Sign in with Google, or other supported authentication services.You are responsible for maintaining access to your account and protecting any associated login credentials.You agree not to impersonate another person, provide intentionally false information, access another player’s account without permission, or interfere with the security or operation of the Application.We may suspend or restrict an account when reasonably necessary to address fraud, abuse, cheating, unauthorized access, or other violations of this Agreement.GAMEPLAY AND ONLINE SERVICESThe Application may include computer-controlled opponents, online matchmaking, private games, Pro Tour competitions, leaderboards, statistics, collectible card decks, emoji reactions, advertisements, and virtual rewards.Online features require an internet connection and may depend on server availability, third-party services, and participation by other players.We do not guarantee uninterrupted access, continuous server availability, specific matchmaking times, or compatibility with every device or internet connection.We may update, modify, suspend, or discontinue features when reasonably necessary to maintain, improve, or protect the Application.GOLF CHIPS AND VIRTUAL ITEMSGolf Chips are virtual in-game items that may be used for eligible features, competitions, card decks, or other content within the Application.Golf Chips may be obtained through gameplay, rewarded advertisements, promotional offers, or Apple in-app purchases.Golf Chips:a. Have no cash or monetary value outside the Application.b. Cannot be exchanged, redeemed, or withdrawn for cash, cryptocurrency, gift cards, merchandise, or real-world prizes.c. Cannot be sold, traded, or transferred outside the Application.d. Are not a bank account, stored-value account, financial product, or property interest.e. May be used only in accordance with the Application’s displayed rules.Golf Chips purchased through Apple in-app purchases do not expire.We may adjust available rewards, eligible features, pricing, or the ways Golf Chips can be earned or used, subject to applicable law and rights associated with completed purchases.IN-APP PURCHASESThe Application may offer consumable Golf Chip purchases through Apple’s in-app purchase system.Prices and available purchase options are displayed before a transaction is completed.Apple processes purchases and payment information. The Developer does not collect or retain your complete payment card or banking information.Purchases are subject to Apple’s billing, payment, refund, and account policies. Refund requests generally must be submitted through Apple unless applicable law requires otherwise.You are responsible for purchases authorized through your Apple Account, subject to applicable parental controls and consumer protection laws.PRO TOUR COMPETITIONSPro Tour is an optional competitive gameplay mode that may require a Golf Chip entry fee.Entry requirements, competition length, potential rewards, and applicable rules will be presented within the Application.The applicable entry fee may be collected when you enter the Pro Tour search or matchmaking session.If you voluntarily leave or cancel after the entry fee has been collected, the Golf Chips used for entry may be forfeited as disclosed in the Application.Players may receive Golf Chip rewards based on their final placement and the rules applicable to the competition.Pro Tour does not award cash, real-world prizes, or redeemable monetary value.Apple does not sponsor, administer, endorse, or participate in Pro Tour competitions.ADVERTISEMENTS AND REWARDED CONTENTThe Application may display third-party advertisements, including rewarded advertisements provided by Google AdMob or other advertising partners.Eligible users may receive Golf Chips after successfully completing a rewarded advertisement and satisfying applicable requirements.Advertisement availability is not guaranteed and may vary depending on advertising inventory, technical conditions, device settings, geographic location, or other factors.We may limit advertisement frequency, reward eligibility, and the number of rewards available during a given period.No reward is owed unless the applicable advertisement and reward requirements are successfully completed.PLAYER CONDUCTYou agree not to:a. Harass, threaten, abuse, impersonate, or intentionally disrupt other players.b. Use bots, scripts, exploits, unauthorized software, or automated tools to gain an unfair advantage.c. Manipulate gameplay, matchmaking, leaderboards, player statistics, purchases, or Golf Chip rewards.d. Attempt to access restricted systems, accounts, or information without authorization.e. Interfere with the Application’s servers, security, or network operations.f. Use the Application for unlawful, deceptive, or fraudulent purposes.We may investigate suspected violations and take reasonable action, including restricting gameplay, removing content, correcting improper rewards, suspending accounts, or terminating access.PRIVACY AND DATA COLLECTIONYour use of the Application is subject to the Fairway 6 Privacy Policy:https://fairway6.com/#privacyThe Application and its service providers may collect information necessary to provide account access, gameplay, online matchmaking, purchases, advertising, customer support, and technical diagnostics.Additional terms governing the Application are available at:https://fairway6.com/#termsINTELLECTUAL PROPERTYThe Application’s software, branding, original designs, gameplay presentation, and related content are owned by the Developer or used under applicable licenses.Certain music, sound effects, software, advertisements, or other materials may belong to third parties and are used under applicable agreements or licenses.You receive permission to use the Application under this Agreement, but you do not acquire ownership of the Application, its content, Golf Chips, card decks, or other virtual items.If a third party claims that the Application or your permitted use of the Application infringes intellectual property rights, the Developer, not Apple, is responsible for investigating, defending, resolving, and discharging that claim as required by applicable law.THIRD-PARTY SERVICESThe Application may interact with third-party services, including Apple, Google, authentication providers, advertising networks, hosting services, and other technology providers.Your use of those services may also be subject to their applicable terms and privacy policies.You agree to comply with applicable third-party terms when using the Application.MAINTENANCE AND SUPPORTThe Developer is responsible for any maintenance or support services required by applicable law or expressly offered for the Application.Apple has no obligation to provide maintenance, customer support, technical assistance, or updates for the Application.For questions, complaints, technical issues, or support requests, contact:Developer: Robert DuvalEmail: [email protected]Telephone: 720-397-7336Website: https://fairway6.comWARRANTY DISCLAIMERTo the maximum extent permitted by applicable law, the Application is provided on an “as is” and “as available” basis without warranties of any kind, whether express, implied, or statutory.This includes, where legally permitted, implied warranties of merchantability, fitness for a particular purpose, noninfringement, and uninterrupted availability.If the Application fails to satisfy an applicable warranty that cannot legally be excluded, you may notify Apple, and Apple may refund the purchase price paid for the Application, if any.To the maximum extent permitted by applicable law, Apple has no other warranty obligations relating to the Application. Any additional claims, damages, liabilities, or costs arising from a warranty issue are the responsibility of the Developer, subject to applicable law.Nothing in this Agreement excludes consumer protections or warranties that cannot legally be waived.PRODUCT CLAIMSThe Developer, not Apple, is responsible for addressing claims relating to the Application or your possession or use of it.These may include:a. Product liability claims.b. Claims that the Application does not comply with applicable legal or regulatory requirements.c. Claims arising under consumer protection, privacy, or similar laws.Nothing in this Agreement limits rights or remedies beyond what applicable law allows.LIMITATION OF LIABILITYTo the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of, or inability to use, the Application.This includes, where legally permitted, losses related to interrupted service, unavailable gameplay features, technical errors, loss of data, or unavailable virtual rewards.To the maximum extent permitted by applicable law, the Developer’s total liability relating to the Application will not exceed the greater of:a.
